Can I
download a form and fax it back to you?
Yes, you can download the Warrant to Distrain form and the Authority to Effect
Forfeiture Form. Once you download the form you will need Adobe Acrobat Software
which is freely available from the internet.
Is
there a long delay before you take action?
We aim to obtain the clients monies as quickly and professionally as possible
without causing disruption to the tenant. Normally we will act within 24 hours
unless you instruct otherwise.
How
much does your service cost?
The service we provide is free with a negotiable nominal fee to the client
when instruction is made in error and our bailiff’s have visited the tenant.
After you collect money from the tenant, when will I have it?
Instant transfer of funds upon receipt of payment or direct to landlord/
managing agents or nominated account.
I
have an urgent case - can you help immediately?
Difficult cases where attention is needed straight away are dealt with on a
higher priority.
What do I have to do to instruct you?
The client has to do nothing more than establish that the tenant is in arrears
of the rent, fill out instruction to Lawson Maclaine via this website, or
download a form for completion by hand and then fax or e-mail. We will return
acknowledgement of the instruction. The client will be updated by the bailiff on
site as to the outcome of the visit.
My
tenant has other financial difficulty - how can you help?
The tenant may be in financial difficulty or has just not paid the rent for that
quarter on time. The client is more than happy for the tenant to pay the debt
off of over a period of time but wants security for this to take place. Lawson
Maclaine can still help. In our experience we have also found that some tenants
that owe commercial rent also have other debts as well, including Business
Rates, Gas, Water Rates, Inland Revenue, Customs and Excise. Once the client has
instructed and a distaint is in place, the client has priority until the debt is
cleared, again ensuring the client gets paid.
Are
Lawson Maclaine's bailiffs qualified and experienced?
Lawson Maclaine only employs certificated Bailiffs who have extensive knowledge
of Distress for Rent Rules 1998. All bailiffs understand that there is monies
owed to the client and will approach this in a firm, professional and diplomatic
manner at all times. We strive to uphold the tenant-landlord relationship in
every way possible. All matters will be dealt with in private.
What information do you gather?
At the time of visits correct information is obtained from the tenant to help
both the client and Lawson Maclaine so that if further visits are needed at a
later date, we have all the relevant details of the tenant as to who to contact
at premises, opening hours and what type of trade they are in.
What if the tenant refuses to pay?
If the tenant refuses to pay and the bailiff has explored all the other avenues
to obtain monies owed we are left with only one option and that is to remove the
goods from the premises. All aspects of removal of goods will be undertaken by
Lawson Maclaine. We would ask from all clients that before taking this action
that Lawson Maclaine have received written confirmation first. At no time will
any goods be removed from any premises without the correct instruction.
Do
you advise the client during your visit to the tenant?
We will abide by the clients rules and instructions at all times but on
arrival, we always keep the client informed about events. As a rule we
have found cleared fund payments are always the way forward either by CHAPS
payment (same day payment) or cash; if the client feels a cheque payment is
acceptable or even card payment, then we would strongly advise that a distaint
is put in place to cover the time taken for the funds to clear.
What happens if a Forfeiture of lease is needed?
If a forfeiture of a lease is needed then the client can instruct us via the
same method. Once the client has filled in the correct form Lawson Maclaine will
take care of everything else that is needed to complete the forfeiture. The
locksmith will be arranged by us, unless you wish to use your own locksmiths.
Once this has been done a fully detailed inventory of goods and photographic
evidence will be taken of any items left in the premises and a forfeiture notice
will be attached to the front of the premises and again photographic evidence
will be taken. The new set of keys will be sent the same day via special
delivery and the client will receive them the following day along with a copy of
the inventory and photos.
